The Territory of Dakota was an organized incorporated territory of the United States that existed from March 2, 1861, [1] until November 2, 1889, when the final extent of the reduced territory was split and admitted to the Union as the states of North and South Dakota.

The territory now known as the Dakotas includes a large portion of the ancestral land of Native American tribes, in particular various tribes of Sioux such as the Dakota people, also known as the Santee Sioux.

Originally, the territory comprised an area that included the present states of North Dakota, South Dakota, and much of Montana and Wyoming. From 1863 to 1864, the area of the territory was limited to the present day Dakotas.

The capital of Dakota Territory was Yankton, located in the southeastern corner of the present-day state of South Dakota. Dr. Jayne, the first territorial governor, lived in a small log cabin, which also served as the governor’s office.

Dakota Territory, created by Congress in 1861, included lands west of present-day Minnesota and almost all of Nebraska Territory north of the forty-third parallel to the Missouri River. Montana Territory was cut off from Dakota Territory in 1864.

In a new territory such as Dakota, government provided a few jobs and created a stable society. The legislature passed laws to encourage the building of railroads, grain mills, and livestock markets. The legislature also passed laws to organize elections and create an orderly democracy.
